You may not use our Services, without limitation, to do anything that includes storing, sending, printing or distributing any content or material which is restricted, prohibited or otherwise unlawful under any applicable law (or which is likely to be), including material and/or content which defames, harasses, threatens, abuses, menaces, offends, violates the privacy of, or incites violence or hatred against, any person or class of persons, or which could give rise to civil or criminal proceedings (or encourages conduct that would constitute a criminal offence or give rise to civil liability);
To do any other act or thing which is unlawful, illegal, fraudulent (or has any unlawful or fraudulent purpose or effect) or is otherwise prohibited under any applicable law or which is in breach of any code, standard or content requirement of any other competent authority;
Failure to comply with this Policy constitutes a material breach of any of our terms and conditions covering the Services that we are providing to you upon which you are permitted to use our Services, and may result in SurfBox disclosing such information to law enforcement authorities as we reasonably feel is necessary
SurfBox does not store users’ payment card details, instead card details are securely transferred to a credit card gateway certified in accordance with the PCI-DSS by means of an encrypted HTML form. Customers who pay by card will be charged in the currency of the country where the service is being offered.
When making cash payment, users must ensure that the 1st coin or note is credited correctly before making further payment. In the event of a payment fault, 2nd and additional notes or coins will not be refunded.
3.1 The Service is provided on as “as is” basis and “as available” basis. We do not make any warranty that the Service will be uninterrupted, timely, secure, or error free, or that Software defects will be corrected or that our Web Portal or the computer that makes it available is free of viruses or other harmful components.
3.2 Nothing in these Terms and Conditions shall exclude or in any way limit SurfBox’s liability for fraud, or for death or personal injury caused by its negligence, or any other liability to the extent that it may not be excluded or limited as a matter of law.
3.3 Subject to clause 3.2, SurfBox shall not be liable under, or in connection with, these Terms and Condition, for:
(a) loss of income;
(b) loss of business profits or contracts;
(c) business interruption;
(d) loss of the use of money or anticipated savings;
(e) loss of information;
(f) loss of opportunity, goodwill or reputation;
(g) loss of, damage to or corruption of data;
(h) cost of procurement of substitute goods or services;
(i) any indirect, special or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise;
(j) loss that result from the use or the inability to use the Service, from any changes to the Service, or from unauthorised access to or alteration of your transmissions or data; or
(k) other intangibles (even if we have been advised of the possibility of such damages) that result from the use or the inability to use the Service, from any changes to the service, or from unauthorised access to or alteration of your transmissions or data.
3.5 Although we attempt to provide you with a high quality service, we cannot guarantee that the Service will never be faulty or that the Service will be available. However, we will use reasonable endeavours to correct reported faults as soon as we reasonably can. In addition, please note that we may need to temporarily suspend the Service for operational reasons (e.g. for repairs, planned maintenance or upgrades).
3.6 You understand and agree that not all viruses or similar harmful programs can be detected or prevented.
3.7 We do not have any liability of any sort (including liability for negligence) for the acts or omissions of providers of telecommunication services or for faults in or failures of their networks and equipment.
Please contact us in respect of any aspect of our service that did not meet your expectations. We will endeavour to rectify any such issues within a reasonable time. Where we are unable to do so we will offer a refund of your payment. Refunds will always be offered in the currency of the country where the service is being offered and will be by one of the following means: (a) Bank transfer directly to the user’s account (IBAN), or (b) refund to the user’s credit/debit card in the event of card payment.
